By accessing or using SummifAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

SummifAI provides meeting summarization services powered by our AI. The Service allows users to:

• Submit meeting notes and transcripts for summarization
• Anonymize sensitive names using blocklist features
• Define industry-specific terms in a glossary
• Access summary history for 30 days
• Purchase credits for summarization services

3. User Accounts

• You must be a United States resident to create an account
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• One person or legal entity may not maintain more than one account

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any laws or regulations
• Upload malicious code or interfere with the Service
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Submit false or misleading information
• Attempt to gain unauthorized access to the Service
• Use the Service for any illegal or unauthorized purpose
• Reverse engineer or attempt to extract source code

5. Content and Intellectual Property

Your Content:

• You retain ownership of content you submit
• You grant us a license to process your content for providing the Service
• You represent that you have the right to submit the content
• You are responsible for the accuracy and legality of your content

Our Content:

• The Service and its original content (excluding user content) are owned by SummifAI
• The Service is protected by copyright, trademark, and other laws
• You may not copy, modify, or distribute the Service without permission

6. Payment Terms

• Credits are purchased on a pay-as-you-go basis
• All payments are processed through Stripe
• Credits do not expire
• Prices are subject to change with 30 days notice
• Refunds are available for unused credits within 30 days of purchase

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

8. Disclaimers and Limitations

No Warranty:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Accuracy:

We do not guarantee the accuracy, completeness, or usefulness of summaries generated by our AI. You should review all summaries for accuracy before use.

Third-Party Services:

We use third-party services (OpenAI, Stripe, Cloudflare) and are not responsible for their actions or service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIFAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our aggregate liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SummifAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

• We may terminate or suspend your account at any time for violation of these Terms
• You may terminate your account at any time through account settings
• Upon termination, your right to use the Service will immediately cease
• Provisions that should survive termination will remain in effect

12. Governing Law and Disputes

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Jurisdiction: By using this Service, you consent to the exclusive jurisdiction of the courts located in California, United States. Users acknowledge that this Service is operated from the United States and is not intended for use by residents of the EU or UK.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
